Clause 6 of the Assam Accord

The citizenship bill does not require any changes if Clause 6 of the Assam Accord is implemented properly, says Assam Chief Minister Sarbananda Sonowal about the proposed legislation which the top BJP leadership has vowed to bring back if voted back to power.

Assam Accord

The years between 1979 and 1985 witnessed huge political instability, collapse of state government, president’s rule and unprecedented ethnic violence in Assam. The elections conducted by the government were totally boycotted and violence based on linguistic and communal identities killed thousands in the state.

The Assam Accord (1985) was a Memorandum of Settlement (MoS) signed between representatives of the Government of India and the leaders of the Assam Movement in New Delhi on 15 August 1985.

As per this accord:

Foreigners who had entered Assam between 1951 and 1961 were to be given full citizenship including the right to vote.
Migrants those who had done so after 1971 were to be deported.
Those who entered between 1961 and 1971 were to be denied voting rights for ten years but would enjoy all other rights of citizenship.

Clause 6 of Assam Accord

Clause 6 of the Assam Accord, which was signed in 1985 after the Assam Agitation of 1979-85, envisages that appropriate constitutional, legislative and administrative safeguards should be provided to protect, preserve and promote the cultural, social, linguistic identity and heritage of the people of Assam.

Citizenship (amendment) bill, 2016

The Citizenship (Amendment) Bill, 2016 aims to provide citizenship to those who had been forced to seek shelter in India because of religious persecution or fear of persecution in their home countries. They are primarily Hindus, Sikhs, Jains, Buddhists, Parsis and Christians from Afghanistan, Pakistan and Bangladesh.

The Bill provides that the registration of Overseas Citizen of India (OCI) cardholders may be cancelled if they violate any law.
